Britney Spears has lost her battle to avoid another day in court - her driving license trial is to go ahead, despite protests from the pop star's lawyer.

J. Michael Flanagan argued his client is still unable to actively participate in her own defence because of her father's ongoing conservatorship.

He also asked that Spears, who was caught driving without a valid California state license last year, simply pay a fine to end the case.

But Spears' driving without a license trial will continue as scheduled, according to a ruling released on Tuesday.

A pretrial hearing is set for Wednesday and the case will begin proper next week.
